By accessing and utilizing , including any associated subdomains, services, software (inclusive of mobile applications enabling Site access), and tools provided on or through HomeaZZon (collectively referred to as the "Site"), you are acknowledging your agreement to abide by these Terms and Conditions of Website Use and all policies outlined on the Site (collectively referred to as the “Agreement”). The terms "HomeaZZon," "us," or "we" refer to HomeaZZon, Inc.

Please read this agreement thoroughly as it constitutes a legally binding contract between you and HomeaZZon. This agreement includes vital terms, such as limitations of liability, choice of forum for disputes, and other conditions that may affect your rights.

HomeaZZon reserves the right to modify this Agreement at any time, and such modifications will become effective immediately upon notifying their users through email website or other appropriate means. It is recommended that you review the current Agreement each time you access the Site. Your continued use of the Site signifies your acceptance of the current Agreement.

USE OF SITE AND SERVICES, AND RESTRICTIONS

The Site encompasses a range of services (“Services”) designed for the management of your personal residence or residences under your ownership, operation, or management. Additionally, these Services cater to real estate agents, brokers, renters, home owners and other professional service providers who utilize our Site or Services for their own professional or other client-related purposes. Upon registration on the Site and settlement of all pertinent fees for these Services, you are granted access to and usage of the Site and Services. This access is granted on a non-exclusive, non-transferable basis, strictly for personal use in compliance with all applicable laws and regulations in the country the user is utilizing the site, software or apps in.

Usage in Accordance with this Agreement

The Site and Services are strictly intended for non-commercial purposes, unless explicitly permitted for real estate professionals' professional use with their clients, with agreement from HomeaZZon.

You are prohibited from:

(If any user is found to violate any of the outlined prohibitions, whether in part or in full, HomeaZZon reserves the right to take immediate action, which may include suspension or termination of access to the Site or Services without prior notice. Additionally, such actions may warrant legal recourse and could result in the pursuit of appropriate legal remedies or actions to recover damages resulting from the infringement. HomeaZZon remains committed to upholding the integrity of its Services and will enforce these prohibitions to maintain a secure and reliable platform for all users.

REGISTRATION FOR SERVICES AND YOUR ACCOUNT

To access specific Services or areas of the Site, registration with HomeaZZon may be required. In this context:

  • We reserve the right to decline the granting of a user name (or e-mail address) that is already in use by another individual.
  • May be interpreted as impersonating someone else.
  • Belongs to another person.
  • Violates the intellectual property or other rights of any person.
  • Is offensive.
  • Is rejected for any other reason at our sole discretion.
  • Your user name and password are intended for your personal use exclusively.
  • HomeaZZon reserves the right, at its sole discretion, to decline service, terminate accounts, modify or remove content, or cancel services.

Representation of Employer and Data Storage Subscription

If you are using the Site on behalf of your employer or company, you affirm that you are duly authorized to do so. Furthermore, your employer or company will be held entirely responsible for your adherence to and any violation of this agreement.

By signing up, you consent to HomeaZZon sending emails to the address provided during registration. These communications may include suggested content, recommendations, reminders, newsletters, promotions, and other notifications concerning the platform and your stored content “ at which you can unsubscribe at anytime”

Subscription Payments

Regarding cancellations and refunds:

For monthly payment subscriptions, canceling services within a billing month will not warrant a refund for that particular month. Refunds for previous billing months are not provided. For annual prepaid subscriptions, canceling services does not guarantee a full or pro-rated refund based on the remaining days in your annual service from the day of cancellation.

Subscription details:

Subscriptions are available on annual or monthly bases, as specified on the Site. The Subscription fee will be based on the price listed on the Site at the time of your Service registration. HomeaZZon retains the right to alter Subscription prices at any time and does not offer price protection or refunds in the event of promotions or price reductions.

Payment methods:

Credit and debit card payments (Visa, MasterCard, American Express, and Discover) “and other payment methods” are the accepted modes for your Subscription fee. Your initial Subscription fee will be charged to your credit or debit card

Subscription Payment Date and Confirmation

Concerning payment dates and confirmation:

  • For your Subscription, the initial fee will be charged to your credit or debit card at the time of processing your order (or upon the expiration of a free-trial period included in your Subscription). Subsequent to the first Subscription fee charge (or after processing your order for a Subscription with a free-trial period), a confirmation email will be sent. This email will confirm your access to the Subscription-exclusive sections of the Site.

Subscription Renewal and Cancellation Policy

Please note the following:

  • HomeaZZon will automatically renew your subscription either monthly or annually. For monthly subscriptions, the renewal occurs on the same date each month, while for annual subscriptions, it renews on the anniversary date of your initial charge.
  • By authorizing HomeaZZon during the sign-up process, your credit or debit card will be charged for the applicable subscription fee, plus any relevant sales taxes, unless you cancel before the renewal date.
  • Each renewal period spans one month or one year, depending on your subscription type.
  • You have the option to cancel your subscription at any time. You can do so by contacting HomeaZZon through the established support line, by emailing info@HomeaZZon.com, or by using the cancellation feature within the HomeaZZon application.
  • Please note that HomeaZZon requires a reasonable processing time for subscription cancellation requests.
  • If you choose to cancel your subscription, you will retain your subscription benefits until the end of the current billing cycle.

Expiration and Free Trial Terms

  • Upon the expiration of your current yearly or monthly subscription term, your subscription benefits will conclude at the end of the respective monthly or yearly term.
  • At the conclusion of the free trial period, if you choose not to convert to a paying subscription, your account will transition to a restricted state where access to the services will be temporarily suspended. Your account information will remain stored but inaccessible until you decide to upgrade to a paid subscription. This restricted status ensures the preservation of your data while your account remains inactive.
  • You are responsible for any applicable sales and use taxes related to your subscription purchase. By registering your account and providing your mailing address, you authorize HomeaZZon to charge your credit or debit card for these taxes.

Specific Rules for Real Estate Professionals

Certain Services offered on the Site are intended for use by real estate agents, brokers, owners, renters and professionals and other users within the real estate industry. By using the Site and Services, real estate professionals acknowledge, warrant, and agree to the following terms:

  • When posting a listing for Real Property on the Site, such as through ® Files, you assert that you have obtained proper authorization from the owner of the Real Property to list it. You agree not to claim or submit listings that you do not represent.
  • You commit to posting listings or providing User Content, including File Content, that is truthful, accurate, and compliant with all applicable laws, rules, regulations, and Fair Housing Laws.
  • You confirm that you hold a valid and active license as a real estate broker or real estate sales agent in good standing within the state where you are licensed to operate. Furthermore, you agree to provide your license number and any other legally required information associated with any listing or offering posted on the Site or Services.
  • You declare affiliation with the real estate broker or company identified in your listing, advertisement, or other posted User Content. Additionally, you affirm that you have the proper authorization to use and grant HomeaZZon the worldwide right to use the name, trademarks, and logos of said broker and company in connection with the respective listing, advertisement, or posting.
  • You commit not to utilize any information regarding HomeaZZon users that you receive while using the Services (such as contact details sent to you when a user contacts you through your listing page) for any purpose other than providing those users with the services they requested. You agree not to rent, sell, or otherwise disclose this information to any third party. Moreover, you pledge not to use this information for unlawful or detrimental purposes or in a manner that reflects adversely on HomeaZZon.
  • You will refrain from spamming or harassing or any other inappropriate behavior of” users on the Site.
  • You agree to adhere to all policies on the Site specifically designed for real estate professionals.
  • The HomeaZZon Professional Site provides various Services, including the provision of annual Upon registering on the Site and completing payment for these Services, you gain access to and may use the Site and Services on a non-exclusive, non-transferable basis for your professional purposes. This usage must align with all pertinent laws and regulations, including Fair Housing Laws and any regulations pertinent to real estate professionals, in accordance with the terms outlined in this Agreement.
  • You might be required to complete a registration process with HomeaZZon to access specific Services or sections within the HomeaZZon Professional Site. During such registration, we retain the right to decline granting you access or usage of a username (or email address) that's already in use, may be seen as impersonating someone else, belongs to another person, directly identifies you, violates intellectual property or other rights of any individual, is offensive, or for any other reason we may reject at our sole discretion.
  • Your username and password are strictly for your professional use. By using the Site, you are accountable for maintaining the confidentiality of your account and password, and you agree to limit access to your computer. Furthermore, you accept responsibility for all activities occurring under your account or password, regardless of whether you authorized or were aware of them. HomeaZZon reserves the right, at its sole discretion, to refuse service, terminate accounts, edit or remove content, or cancel services.
  • If you register an account and utilize the Site on behalf of your employer, broker, or company, you affirm that you are authorized to do so. Moreover, you declare that your employer, broker, or company will bear complete responsibility for your compliance with and any breaches of this Agreement.

For Users who are Affiliate Marketing Partners they agree to:

  • Create, host, publish, promote, distribute, and maintain HomeaZZon Affiliate Links (HZ Affiliate Links) at their discretion.
  • Ensure that all HZ Affiliate Links include the HomeaZZon name and/or logo, which should be clickable hyperlinks directing users to the HomeaZZon Website.
  • Maintain the confidentiality of information obtained from HomeaZZon, disclosing it only as necessary to fulfill obligations and taking steps to protect all material information.
  • Obtain prior approval from HomeaZZon for any creative materials used in HomeaZZon advertising campaigns.

HomeaZZon hereby agrees to:

  • Provide End Users with HZ Affiliate Links for hosting on their websites or displaying in marketing materials, newsletters, social media posts, or email transmissions.
  • Furnish End Users with guidelines and graphical artwork necessary to create content for promoting the HZ Affiliate Link.
  • Use the HZ Affiliate Link to track individual users who access the HomeaZZon Website through End Users' websites or promotions and successfully sign up for an account.

However, HomeaZZon will be unable to track accounts if the specific link format used by the End Users does not comply with the prescribed guidelines. Therefore, HomeaZZon will have no obligation to track such accounts.

Neither Party may utilize the other Party's Marks or any other intellectual property for any purpose beyond this Agreement without prior written consent from the owning Party, HomeaZZon. Both Parties agree to adhere to the standards and guidelines set by the owning Party concerning the proper use and display of the Marks. Once consent is granted for a specific type of use (e.g., promotional materials or website usage), subsequent use in that specific context does not require further consent.

Each Party acknowledges the validity of and commits to actions that do not undermine the other Party's rights or ownership of its Marks and associated goodwill. Any use of the other Party's Marks shall exclusively benefit the owning Party. Neither Party will attempt to reserve, register, or file applications for registration of the other Party's Marks or any confusingly similar marks, whether as corporate or trade names, domain names, trademarks, or service marks, in any country or territory or with any registrar.

Unauthorized use of the Marks, inconsistent with the terms herein or without written consent, is strictly prohibited. Any unauthorized use shall warrant immediate cancellation of authorization to use a Party's Marks

Acknowledging the inherent value of advertising in establishing and upholding the goodwill and public perception of the Marks, each Party agrees that any advertising and promotional activities featuring the Marks must be conducted with dignity. Neither Party will intentionally display, broadcast, transmit, or distribute any advertising or promotional material that:

  1. Includes material misrepresentations or omits material facts, whether regarding the involved parties, their affiliates, their competitors, or their respective products and services.
  2. Contains statements derogatory toward the other Party, its affiliates, its Marks, products, or services.

FAIR HOUSING

All real estate content on this Site is governed by the Federal Fair Housing Act of 1968, as amended. This Act prohibits advertising any preference, limitation, or discrimination based on race, color, religion, sex, handicap, familial status, or national origin, or an intention to make any such preference, limitation, or discrimination. HomeaZZon does not knowingly accept any advertisement for real estate that violates this law. Users of this Site are hereby advised that, in accordance with applicable laws and regulations, all dwellings advertised in the ® File service are available on an equal opportunity basis. For further information on Fair Housing Laws, visit The U.S. Department of Housing and Urban Development (“HUD”) website.

ACCURACY OF INFORMATION PROVIDED BY YOU

When registering your account, it's essential to provide accurate and comprehensive information. If any updates or changes occur, promptly revise your details. By using the Site, you assure that all information, documents, photos, or materials you submit are and will remain true, accurate, and complete. Failure to maintain such accuracy may result in the suspension of your account and services.

NO ENDORSEMENT

HomeaZZon doesn't endorse, sponsor, recommend, or approve any real estate agent, broker, mortgage broker, or other HomeaZZon-related service provider offering services through the Site. While we attempt to verify the licensing of participating Real Estate Providers, we cannot guarantee their qualifications or capabilities. Mention of products, services, or other information doesn't imply our endorsement or sponsorship.

MOBILE APPLICATIONS

HomeaZZon may offer Mobile Applications for accessing the Site via mobile devices. You must have a compatible mobile device, although HomeaZZon cannot guarantee compatibility. Upon using the Mobile Application, you receive a non-exclusive, non-transferable, revocable license for a single registered account on a mobile device owned or leased solely by you, for personal use. You agree not to:

  • Modify, disassemble, decompile, or reverse engineer the Mobile Application, except where expressly permitted by law.
  • Rent, lease, loan, resell, sublicense, distribute, or transfer the Mobile Application to any third party or use it for time-sharing services.
  • Create copies of the Mobile Application.
  • Interfere with security features, content access, or any usage limitations of the Mobile Application.
  • Remove copyright or proprietary notices on the Mobile Application.

You acknowledge that HomeaZZon may issue updated versions of the Mobile Application, and you consent to automatic upgrades on your device, subject to the terms of this Agreement. This license grant doesn't constitute a sale of the Mobile Application, and HomeaZZon and its licensors retain all rights to the Mobile Application and copies thereof. Standard carrier data charges may apply to Mobile Application usage.

iOS App Terms:

  • You acknowledge that this Agreement is solely between you and HomeaZZon and not with Apple, Inc. ("Apple").
  • Your usage of HomeaZZon’s iOS App must adhere to Apple’s prevailing App Store Terms of Service.
  • HomeaZZon is exclusively responsible for our iOS App, its Services, and accessible content. You understand that Apple isn't obliged to offer maintenance or support services for our iOS App. Apple has no warranty obligations concerning our iOS App, to the maximum extent permissible by applicable law.
  • Any claims by you or any third party concerning our iOS App or its usage are the responsibility of HomeaZZon, not Apple. This includes product liability claims, conformity to legal requirements, consumer protection claims, or similar matters, all governed solely by this Agreement and our applicable laws as the provider of the iOS App.
  • HomeaZZon will handle any third-party intellectual property infringement claims regarding our iOS App or its usage to the extent required by this Agreement.
  • You confirm and warrant that (i) you're not in a country under U.S. Government embargo or designated as a "terrorist supporting" country; and (ii) you're not listed on any U.S. Government list of prohibited or restricted parties.
  • Compliance with all applicable third-party agreements is expected when using our iOS App (e.g., adhering to your wireless data service terms).

The parties agree that Apple and its subsidiaries are considered third-party beneficiaries concerning your iOS App license under this Agreement. Your acceptance of this Agreement grants Apple the right (and will be deemed as accepted) to enforce this Agreement concerning your iOS App license as a third-party beneficiary.

Android App Terms:

  • You acknowledge that this Agreement is solely between you and HomeaZZon and not with Google, Inc. ("Google").
  • Your usage of HomeaZZon’s Android App must comply with Google’s prevailing Android Market Terms of Service.
  • Google merely provides the Android Market where you acquired the Android App. HomeaZZon is exclusively responsible for our Android App, its Services, and available content. Google has no obligations or liabilities regarding HomeaZZon’s Android App or this Agreement.

Google is acknowledged as a third-party beneficiary to this Agreement concerning HomeaZZon’s Android App.

GEOLOCATION TERMS:

The Services may incorporate specific functionality and services offered by third parties, enabling HomeaZZon to integrate maps, geocoding, places, and related content from Google, Inc. (“Google”) as part of the Services (referred to as the “Geo-Location Services”). In the event we provide such functionality or services, your utilization of the Geo-Location Services is subject to Google’s prevailing Terms of Use for Google Maps/Google Earth (http://www.google.com/intl/en_us/help/terms_maps.html). By utilizing the Geo-Location Services, you thereby agree to adhere to and be bound by Google’s Terms of Use.

PRIVACY POLICY:

All personal information provided during your registration and utilization of the Site falls under the purview of the HomeaZZon Privacy Policy accessible at Your usage of the Site or its Services implies your consent and commitment to adhere to the terms stipulated in the Privacy Policy.

USER SUBMISSIONS:

The Site enables you to upload, post, and exhibit documents pertaining to your residence, including “User Content” and engage with “Interactive Features”. Your use of any Interactive Feature is solely at your own risk.

By submitting User Content or engaging in an Interactive Feature within or in connection with the Site, you agree to the following terms:

  • (a) Not to upload User Content that infringes upon the rights of others or is defamatory, harassing, or threatening.
  • (b) Not to post offensive content or expressions of bigotry, racism, or profanity.
  • (c) Not to display any minor's or third party's personal information without explicit consent.
  • (d) Not to transmit sexually explicit or obscene material.
  • (k) Not to post false, misleading, or inaccurate information.

Any User Content breaching these requirements may be removed at HomeaZZon's discretion. HomeaZZon reserves the right to screen, edit, or remove User Content at any time.

By submitting User Content, you grant HomeaZZon a royalty-free, perpetual, irrevocable license to use your User Content as described.

POSTING AND TRANSFER OF USER CONTENT (INCLUDING ® File CONTENT)

You may post and transfer User Content on the Site, affirming that you possess the full rights to do so. HomeaZZon is not responsible for any loss or damage to User Content. Always maintain a backup copy of your User Content.

TERMINATION

HomeaZZon may terminate your account if you violate any terms of this Agreement. Upon termination, your access to the Site and related information will cease, and HomeaZZon is not liable for any losses following termination. Provisions intended to survive termination will remain in effect.

COMMENTS / FEEDBACK

We value your comments and feedback on our Site, products, and services. We do not accept confidential or proprietary information. Therefore, any comments, feedback, ideas, suggestions, materials, information, product designs or concepts, and other submissions provided to HomeaZZon (collectively, “Comments”) are not considered confidential and will become the property of HomeaZZon. By submitting Comments, you grant HomeaZZon worldwide rights without compensation. Comments must be non-infringing and not contain unlawful material.

INTELLECTUAL PROPERTY RIGHTS

All content on the Site, including "Content", is owned or licensed by HomeaZZon. The Content is protected by various intellectual property laws. HomeaZZon®, its logo, and all other trademarks mentioned are property of their respective owners and imply no endorsement. All intellectual property rights related to all Content are explicitly reserved by HomeaZZon and its suppliers and licensors.

COMMERCIAL SOFTWARE & THIRD-PARTY LINKS

  • The Mobile Application software provided through the Site is classified as "Commercial Items". Government end users are licensed under the same terms and conditions as other end users.
  • The Site may include links to third-party websites (“Third Party Sites”). HomeaZZon is not responsible for the content of any Third Party Site. Review their terms and privacy policies before engaging.
  • HomeaZZon may display advertisements for related products and services. We are not responsible for the actions or quality of these advertisers. Engaging with advertisers is at your own risk, and HomeaZZon might receive commissions or fees from these advertisers.

Advertisements and links on the Site are not an endorsement by HomeaZZon. You use Third-Party Sites and resources at your own risk.

DISCLAIMERS OF WARRANTIES — GENERAL

While HomeaZZon endeavors to ensure the safety of your access and use of the Site, it cannot guarantee that the Site or its server will be error-free, uninterrupted, or free from unauthorized access. The Site and all its content are provided on an "as is," "as available" basis without warranties of any kind.

HomeaZZon explicitly disclaims all warranties, express or implied, to the extent permitted by law. This includes but is not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. HomeaZZon will not be liable for any damages arising from the use of the Site unless otherwise specified in writing.

Separate providers of products may offer their own warranties, which are not covered by this disclaimer.

THIRD-PARTY CONTENT AND LINKS

HomeaZZon is not liable for any damage or loss arising from the use of third-party advertisements or links on the Site. If you choose to engage with any third-party sites, you do so at your own risk.

GEOGRAPHICAL LIMITATION

The Site is operated from the United States and is not intended to subject HomeaZZon to any jurisdiction outside the United States. HomeaZZon does not warrant that the Site is appropriate or available for use in other jurisdictions.

LIMITATION OF LIABILITY

HomeaZZon, its employees, and its suppliers will not be liable for any direct or indirect losses or damages arising from your use of the Site. If you are dissatisfied with the Site, your sole remedy is to discontinue its use.

REPRESENTATIONS AND WARRANTIES / INDEMNIFICATION AND DEFENSE OF HOMEAZZON

You warrant that your User Content is accurate and non-infringing. You agree to indemnify HomeaZZon against any claims arising from your use of the Site or breaches of this Agreement.

ENFORCEMENT OF THIS AGREEMENT

Your use of the Site is governed by this Agreement and the laws of the State of California, United States of America. Any legal action related to this Agreement will be brought in the federal or state courts of Sacramento, California.

ELECTRONIC COMMUNICATIONS

You consent to receive electronic communications from HomeaZZon, either in the form of emails sent to your listed email address or communications posted on the Sites such as push notifications. You acknowledge and agree that any electronic communication, whether in the form of email or posted on the Sites, satisfies any legal requirement for written communication.

INTELLECTUAL PROPERTY INFRINGEMENT

We respect the intellectual property rights of others and expect users to do the same. We have a policy to remove User Submissions that violate intellectual property rights, suspend access to this Site for any user infringing someone’s intellectual property rights, and terminate the account of any user using this Site or Services in violation of someone’s intellectual property rights.

Pursuant to Title 17 of the United States Code, Section 512 (“DMCA”), we have established procedures to handle claims of copyright infringement. If you believe that your copyright or intellectual property rights are being infringed upon by a user of this Website, please submit a written notification to our team.

For us to take immediate action on your claim, your written notice must include the following:

  • Your physical or electronic signature.
  • Identification of the copyrighted work or intellectual property alleged to have been infringed.
  • Precise identification of the allegedly infringing material for us to locate it.
  • Adequate contact information to reach you (postal address, telephone number, and e-mail address).
  • A statement indicating your good faith belief that the use of the copyrighted material is unauthorized by the owner, their agent, or the law.
  • A statement affirming the accuracy of the information in the notice.
  • A statement, made under penalty of perjury, confirming your authorization to act on behalf of the copyright or intellectual property owner.

Please note that unless the notice pertains to copyright or other intellectual property infringement, our Agent will be unable to address the listed concern.

Submitting a DMCA Counter-Notification:

If your material has been removed due to a DMCA take-down notice, you may submit a counter-notification including:

  • Your physical or electronic signature.
  • Identification of the removed material and where it was located before removal.
  • A statement under penalty of perjury that the material was removed by mistake or misidentification.
  • Your contact information and a statement consenting to the jurisdiction of a court in your area, or if outside the U.S., where HomeaZZon may be located, along with your willingness to accept service of process from the original notifying party.

Termination of Repeat Infringers:

We may terminate the accounts or access of users who are the subject of repeated DMCA or other infringement notifications.

MISCELLANEOUS:

This Agreement constitutes the entire agreement between you and HomeaZZon regarding the Site and Services. Any waiver must be in writing, and no failure to exercise rights under this Agreement shall be considered a waiver. Invalid provisions will not affect the remaining provisions, and this Agreement does not establish any form of partnership or employment relationship between the parties. Changes to this Agreement will be communicated through the Site or via email.
